By purchasing a ticket and/or visiting Open Harvest ("the Farm"), you acknowledge that you have read, understood, and agree to the terms below on behalf of yourself and any minors or guests accompanying you.

1. Nature of the Activity

Open Harvest is a working, outdoor agricultural property. Activities include walking on natural and uneven terrain, harvesting fruits and vegetables, and general exposure to a farm environment. This is not a manicured park or controlled indoor space.

2. Assumption of Risk

I understand and acknowledge that visiting and participating in activities at Open Harvest involves inherent risks, including but not limited to:


Uneven, muddy, rocky, or slippery ground and pathways
Exposure to insects, including bees, wasps, and other wildlife commonly found in agricultural and natural settings
Exposure to sun, heat, wind, rain, and other weather conditions
Contact with plants, including thorns, irritants, or allergens
Physical exertion associated with walking, bending, and harvesting
The general unpredictability of an outdoor, natural environment


I voluntarily assume full responsibility for any risks of loss, property damage, illness, or personal injury, including death, that may be sustained by myself or any member of my group while visiting the Farm, whether caused by negligence or otherwise.

3. Release of Liability

In consideration of being permitted to visit and participate in activities at Open Harvest, I, on behalf of myself, my heirs, assigns, and personal representatives, hereby release, waive, discharge, and covenant not to sue Open Harvest, its owner(s), employees, and agents (collectively, "the Farm") from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, illness, or injury that may be sustained while on the Farm's property, except in cases of gross negligence or intentional misconduct.

4. Medical Conditions and Allergies

I confirm that I am not aware of any medical condition, allergy (including but not limited to insect sting allergies), or other condition that would make my participation in this visit unreasonably dangerous, or I have disclosed any such condition to Open Harvest in advance and take full responsibility for managing it during my visit.

5. Responsibility for Minors

If I am bringing a minor (under 18) onto the property, I confirm that I am their parent, legal guardian, or have been authorized by a parent/guardian to supervise them, and I accept full responsibility for their safety and conduct during the visit.

6. Property and Conduct

I agree to follow all posted and verbally communicated farm rules, including staying within designated areas and following any instructions given by Open Harvest staff. I understand that failure to do so may result in being asked to leave without a refund.

7. Acknowledgment

I have read this waiver, understand its terms, understand that I am giving up substantial legal rights by agreeing to it, and sign it freely and voluntarily without any inducement.
